Legally no you are not. it is considered a virtual item (ebay will remove the post if some one / xbox reports it to them)
alot of the time people over look it on there though cause its not a item most people think would buy / sell on there.
you can sell shit like microsoft point / gold memberships caue that actually comes on something tangable.
the accounts / tags are just virtual items, theyre policy is if you cant physically hold and or touch it then your not supposed to sell it there
