We'll as some of you know, I was arrested last week on Saturday.
My court date is May 30th and I need to make a good story up so I won't have to make pay so much if I get charged.

I was thinking along this, can people please give opinions and help me out aha.. Btw I live in Canada. This isn't my first time arrested but first time going to court after age 16.

My story:
Me and my friend (I don't know if I should involve him or not, the cops are aware of him being their) we're walking back from a friends house (friends/movies/food/store etc..) and we went through a parking lot and saw a car door open, so we decided why not and try to see if anything is in their. We found an MP3 player and looked at 1 or 2 more cars and than left walking home.

That's basically it. I stole on a Thursday night and posted an ad on Kijiji (local classified ad site, I know this was stupid on my part) on Friday 7p.m. We got a reply an hour later from a guy asking if we could meet up and sell it to him. We said sure, we met at 9:30 at a variety store and he looked at it but said he had no money on him tonight and he'll buy it tomorrow. The next day at 11a.m I get set-up by cops and got charged with possession of stolen property.

Say you found it near a local store and took it because you figured it was a friends but you were wrong so you sold it.

That is a really smart set-up >_>

I think it would be a bad idea for any of us to help you, as if they catch your lie, they can check your recent internet shit and find this then get us involved.

Just a thought.

Bitches can find me, I probably live near him (As I live in Canada).

If your under 18 and its your first problem with the law just tell the truth. Just be apologetic and the judge will probably give you a very minor slap on the wrist.

If neither of those are true, expect the worse punishment possible for the crime

I'm under 18.
I've been in trouble like 4 times but never actually charged and taken to court.
When I was 13, I got arrested for theft under $5000. They let me go.
In grade 9 I got caught with a personal amount of weed, no charge
2 months ago got caught with a pipe, no charge

Ah, car hoppin'... much fun.

Did this for a whole summer and it supplied me with about $400+ a night easily (plus more shit to sell).

Do you live in Ontario? I just know some laws differ between provinces and you may get a harsher punishment elsewhere.

Me and a couple buddies were caught one night with about $350 cash + a whole fuckload of uncounted change, a few iPods + other MP3 players, watches, GPS's, DVD players, stereo's, and we had our bong + quarter on us.

All we got was Youth Diversion, lol.

You are only supposed to get it once, but this was my second time on it and 1 of my buddies second time on it.

All it does is make you go to a couple meetings, I had to do 35 hours of community service and I had to create a bristol board project on keeping your car doors locked at night, lol.

So, I see you have no previous offences and you are under the age of 18. You are going to get a slap on the wrist, especially if you just admit it.

You'll be fine.

Ok so, you have been set up and arrested so we know you cant avoid being charged. So you have to live with the fact that you ARE going to get charged. I assume you went into the car out of curiosity of what lies inside .. but im positive that you cannot use "curiosity" as a defence in court. To be honest, you were setup up and identified with a stolen item at pointblank range of a police officer and i dont think there is much of a story you can make up to the judiciary(judge). All you can use is partial defences to lessen your case. These can include the fact that your young and you saw someone do it on tv which blames it on the media, Or you can tell the court that you didnt know what you were doing was wrong(for some odd reason). And a complete defence(excuse that lets you off completely) you could use is Mental Illness, So unless your mentally impaired, you should use your age and the "fact" that you didnt know it was wrong as an excuse for doing it. One more thing, you can use "Plea Bargaining" or in other words "Charge Negotiation" to lessen your charge. Plea bargaining is pleading guilty to the court when you are asked if you please guilty or not guilty. You can be rewarded with a lesser charge if you do this in the courtroom. For example, many people in the past and in present time are having their charges decreased in severity like MURDER TO MAN-SLAUGHTER.

I hope this helps you, even though telling the truth is always the best option if you want to avoid further court hearings. Good luck on the 30th of may buddy. AND ALSO, IF YOUR PREVIOUS ARRESTS INCLUDE THE SAME ACT YOU DID EARLIER, THEN YOU CAN GET CHARGED EVEN MORE FOR AGGREVATED BREAK AND ENTER BECAUSE IT IS A RE-OFFENCE. CYA !

Wow.. Runescape basically summed up the situation I'm stuck in.
I'm still debating if I should say I broke into the car, saw that it was open or what..
I'm still under 18 so my charge can't be that bad... I told the cop I basically open the car door and took what I saw...

Thanks to Steezy also as you have experience and helped me out a bit.

I have one question, if the cop says anything like "we'll put you in jail if you don't say the truth" can they literally do what they want? or is it just trying to scare.. The cop tried to pull something sneaky like this on me, it didn't really work to well to his advantage..

If I learned one thing from my old man, it is to NEVER talk to a cop accusing you of a crime without a lawyer present.

Ok, I know what to do in the future, but I'm stuck in a sticky situation, should I just try and feel bad for what i've done so they let me off easily?

If its your first major offence and your under 18, than that is definitely your best option.

You may live near him but I live about 20-30 minutes away from him :D.

But, I think you could say you went to check the car out and make sure there was nothing in value so you shut the door and continued walking home. As you were walking home, you found something on the side of the road and it looked like it was in somebody's trash so you picked it up and took it home. Then, say you didn't need the item and didn't think it was stolen so you put it up on Kijiji.

I think that is a pretty good story if you follow through with it and think of all the possible questions they are going to ask you and find out how you will answer them. Good luck buddy.

Rofl, don't pull the whole "I am not talking without a Lawyer" or it is going to give you a worse outcome.

You are under 18, no previous offences, and all you did was take a couple things.

It is petty theft.

Honestly, just admit what you did. Tell them the door was unlocked, so you went into the car and took what you saw.

Honestly, you told me you live in Ontario and you are more than likely just going to get a slap on the wrist.

Like I said, I was busted with $1500+ of stuff on me, plus a quarter of weed and a bong... never got charged.

I couldn't be fucked to read RuneScape's wall of text, but from what I have read he has KIND of hit the nail on the head.

Just remember, stay confident, if you lie, STICK to the lies because they are going to try and twist your words on you.

And one last thing, if the cop tries to strong arm you with the "If you don't tell us the truth then we are going to toss you in a cell", don't buy it, lol. That is one of the oldest and most retarded scare tactics they can pull and only the naive are going to fall for it.
